India: Supreme court advisory to farmers seeking protest approval

In its ruling, the supreme court ruled that citizens have the right to move freely and without fear and that their property is being damaged in the protests.

“You have strangulated the entire city and now you want to come within the city and start protest again here,” said the supreme court, in response to farmers’ protest against three farm laws and a request for permission to stage a Satyagraha in Jantar Mantar.

An A M Khanwilkar and C T Ravikumar bench told counsel for Kisan Mahapanchayat, an association of farmers and agriculturists, that after their appeal, they should have faith in the judicial system and let it resolve the matter.

“There has to be some balance.” said the supreme court.

According to the bench, the petitioners must file an affidavit declaring they are not taking part in the protest being held and the blocking of national highways at the city’s border. A further hearing will be done on October 4th.

The Farmers Produce Trade and Commerce (Promotion and Facilitation) Act, 2020, The Essential Commodities (Amendment) Act, 2020, andThe Farmers (Empowerment and Protection) Agreement on Price Assurance and Farm Services Act,2020 are being opposed by several farmer organizations.

The protests began in Punjab in November last year and eventually spread to Delhi, Haryana, and Uttar Pradesh.
